1. Introduction
Welcome to the website and services of Lotus Spirit Counseling and Yoga LLC ("we", "us", or "our"). By using our site, booking services, or participating in counseling, yoga, or wellness programs, you agree to these Terms & Conditions and acknowledge our Privacy Policy. If you do not agree with these terms, please do not use our services.
2. Counseling Services
Counseling services are provided by Jessica Eriksen, MS, Registered Counselor Associate, under the supervision and in accordance with Oregon state requirements. Counseling is clinical in nature and is intended for clients residing in jurisdictions where services are authorized. Counseling sessions are confidential as required by law and applicable privacy regulations (including HIPAA).
Counseling Fees: $150 per 60-minute session. Limited sliding-scale spots may be available upon request. We do not accept in-network insurance; a superbill can be provided for potential out-of-network reimbursement.
3. Yoga & Wellness Services
Yoga classes, workshops, retreats, and private sessions are offered for general wellness, education, and personal development. These services are not a substitute for medical care or psychotherapy. Participants are responsible for evaluating their own fitness for participation and consulting a healthcare provider as needed.
Participation is voluntary. Instructors may offer modifications and encourage students to move within their comfort and ability. Group classes are not private or confidential settings.
4. Eligibility & Client Responsibility
Counseling: You must be located in Oregon (or another jurisdiction where services are legally permitted) at the time of your session. Clients must provide accurate information and follow professional recommendations as appropriate.
Yoga & Wellness: You are responsible for informing instructors of medical conditions, injuries, or limitations. Practice mindfully and stop any activity that causes pain or discomfort.
5. Informed Consent & Assumption of Risk
Counseling Risks & Benefits: Counseling may involve discussing difficult emotions and memories. Benefits can include increased self-understanding, symptom relief, and improved relationships. No specific outcomes can be guaranteed.
Yoga & Wellness Risks: Physical movement and breathwork carry inherent risk of injury. By participating, you voluntarily assume all risks and agree not to hold the provider liable for any injury, loss, or damage resulting from participation.
6. Payment & Cancellation Policy
Payment is due at the time of service unless otherwise arranged. Accepted payment methods: cash, PayPal, credit/debit card.
Counseling: $150 per 60-minute session. A minimum of 48 hours’ notice is required to cancel or reschedule without charge. Cancellations with less than 48 hours’ notice or no-shows may be charged the full session fee.
Yoga/Workshops: Rates, refund, and cancellation policies are provided at registration and may vary by event.
7. Confidentiality & Privacy
Counseling confidentiality is maintained in accordance with HIPAA and professional ethical standards. Exceptions to confidentiality include: imminent risk of harm to self or others; suspected abuse or neglect of a child, elder, or vulnerable adult; court orders or other legal obligations.
Yoga & Wellness: Group classes and workshops are public settings, and I cannot guarantee confidentiality for any personal information shared during these activities.
Data Collection & Use: We collect personal contact details, intake information, and service history to provide services, process payments, and comply with legal requirements. Your data will not be shared with third parties except as required by law.
8. Communication & Technology Use
We may use email, phone, or secure telehealth platforms to communicate with you. While we take steps to protect your privacy, unencrypted communications (such as standard email or text messaging) carry some security risks.
Telehealth: Clients using telehealth must be located in Oregon (or an authorized jurisdiction) and should use a private, secure location during sessions.
9. Termination of Services
I reserve the right to terminate services if: nonpayment occurs; client behavior is abusive or unsafe; the client’s needs exceed the clinician’s scope of practice; or legal/ethical obligations require termination. Clients may end services at any time.
10. Waiver & Release of Liability — Yoga & Wellness Services
By participating in yoga or wellness activities, you acknowledge the inherent risks and release the provider from liability for ordinary negligence, injury, loss, or damage arising from participation, except in cases of gross negligence or willful misconduct.
11. Reiki Services

Nature of Service: Reiki is a Japanese energy-healing practice intended to promote relaxation, stress reduction, and overall well-being. It is a complementary therapy and is not a substitute for professional medical diagnosis, treatment, or mental health care.

Scope & Limitations: Practitioners do not diagnose, prescribe, or guarantee outcomes. You should consult with a qualified healthcare provider for any medical concerns before beginning Reiki sessions.

Consent to Treatment: Reiki sessions may be conducted with gentle touch or no touch, depending on your comfort level. You have the right to request a no-touch session at any time.

Possible Responses: Reiki is generally considered safe, but you may experience temporary sensations such as warmth, tingling, emotional release, or mild fatigue following a session.

Client Responsibility: Inform the practitioner of any medical conditions, injuries, or other concerns before the session. Continue with any existing medical treatment plans unless advised otherwise by your licensed healthcare provider.

Confidentiality: Information shared in Reiki sessions is kept private, except as required by law.

12. Changes to Terms & Policy
We may update these Terms & Conditions and Privacy Policy from time to time. The most recent version will be posted on our website with the effective date. Continued use of services indicates acceptance of updated terms.
